Streatham shopkeeper fined for selling tobacco to children

A Streatham shop keeper has been fined by a court after being caught selling cigarettes to under-age children during test purchases by trading standards.

Lambeth council will now seek to take further action against Amratlal Shah, 66, from Jaina Newsagents in Streatham High Road, Streatham following his latest conviction.

Cllr Jack Hopkins, Cabinet member for Safer Stronger Communities, said: “We are working with shopkeepers in the borough to make sure business people are aware of their obligations.

“Where they fail to meet the standards required we will take action, as this successful prosecution shows. We are determined to stamp out the illegal sale of alcohol and cigarettes and will use the full force of the law to protect children in Lambeth.”

Mr Shah appeared at Tower Bridge Magistrates’ Court on Monday, January 7 where he pleaded not guilty to two charges of selling tobacco to under-18s on June 7 and August 28 last year.

But the business owner was found guilty after evidence was presented by the council’s Trading Standards team.

Mr Shah, of Fairlands Avenue, Thornton Heath, was fined £400 for each offence, ordered to pay a £15 victim surcharge and contribute £400 towards prosecution costs – £1,215 in total.

He had previously been convicted on July 26, 2011 for an under-age tobacco sale offence for which he received a 12-month conditional discharge.

He was also convicted on May 22, 2012 for the same offence and fined £400, ordered to pay a £15 victim surcharge and £380 toward prosecution costs.  He was also fined £200.00 in respect of the conviction on July 26 2011.

Lambeth Council will now apply for an order restricting Mr Shah from being involved in the sale or management of tobacco products. If granted the restrictions could apply for up to a year.
